By entering High Country Harley-Davidson’s Motorcycle Giveaway (a “Giveaway”), you agree to these Official Rules, which are a contract, so read them carefully before entering.
The High Country Harley-Davidson® Motorcycle Giveaway entry period begins on March 30, 2024 and ends at 2:59pm MST on June 29, 2024.
ELIGIBILITY
Giveaways are open to all legal residents of the United States (including Hawaii and Alaska) and the District of Columbia who has attained the age of majority in his or her state. Employees, officers and representatives of Sponsors, and any of their immediately family members and household members and those of any corporate affiliates, subsidiaries, licensors, dealerships, distributors, retailers, sales representatives, advertising and promotion agencies and any other entities directly associated with this promotion (together the “Released Parties”) are also not eligible to participate. All federal, state and local laws and regulations apply. Void where prohibited by law.
HOW TO ENTER
During the Giveaway entry period, participants must fill out the entry form, that includes the participant’s name, phone number, and email address, which will be used to communicate with entrants and fulfill the Giveaway obligations. The winner must be present in High Country Harley-Davidson® Cheyenne at 3pm MST on June 29, 2024 to claim the prize. Once submitted, responses cannot be deleted, canceled or modified. One entry per person per day. We reserve the right to exclude anyone we suspect of fraud.
PRIZE
The winner is subject to verification and validation of compliance with these official rules by High Country Harley-Davidson® Cheyenne. Giveaways have no cash value and cannot be redeemed for cash or credit to a credit card or store credit. The approximate retail value of the prizes is $3,699.00. Sponsor reserves the right to substitute any or all of the prizes with an article or service of similar or greater value at its sole discretion. Prizes may not be assigned or transferred.
PRIZE CONDITIONS
By accepting any prize, the prize winner agrees to release the Sponsors from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. All local, state and federal taxes are solely the responsibility of the Winner. No substitution or transfer of Prize will be permitted. The Sponsor(s) reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. The Winner’s entry, and acceptance of the prizes offered constitutes permission (except where prohibited) for the Sponsors to use said Winner’s name, photograph, likeness, statements, in all forms of media, in perpetuity, without notice of further compensation. Winners will receive a Form 1099 and are responsible for all taxes on the prize.
TAXES
Federal, state and local taxes are the sole responsibility of the winners.
INTERNET LIMITATIONS OF LIABILITY
If for any reason this Giveaway is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, Sponsors reserve the right, at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, or for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsors on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Giveaway or downloading any materials in the Giveaway.
Caution: any attempt to deliberately damage the website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, the sponsors reserve the right to seek damages or other remedies from any such person responsible for the attempt to the fullest extent permitted by law. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) That is responsible for assigning email addresses for the domain associated with the substitute email address.
DISPUTES
Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, a Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Wyoming. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsors in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Wyoming, without giving effect to any choice of law or conflict of law rules (whether of the State of Wyoming or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wyoming.
